Terms of Service
Who this is between
These terms are between Followly, based in Belgium, and the business signing up for the service (“you”). Followly is provided business-to-business, to sole traders and companies acting within their trade or profession, not to consumers acting for personal, non-business purposes.
What Followly is
Followly is follow-up and scheduling automation software: it watches the customer and appointment records in your account and, based on rules you set, proposes appointments, creates follow-up tasks, and logs every action it takes in plain language. It runs automatically once you’ve configured it, and you can turn any rule off at any time.
Your account
One account per business, with one owner account and any number of team members the owner adds. You’re responsible for keeping login credentials confidential and for everything that happens under your account. Tell us right away if you think an account has been compromised.
Setup
If you use our white-glove setup, you tell us what you currently use for scheduling and customer records, and we import that data into your Followly account and help configure your first rules. You stay responsible for the accuracy of the data you give us to import.
Subscription and billing
Paid plans are billed monthly through Stripe, in advance, at the price shown for your plan at signup. There’s no long-term contract. You can cancel at any time, effective at the end of the current billing period, and we don’t refund partial periods. We may change prices for future billing periods with reasonable notice.
Acceptable use
You agree not to use Followly to:
- send unsolicited communications that violate applicable law (e.g. spam or unlawful marketing),
- store or process data you don’t have a lawful basis to hold,
- attempt to break, overload, or gain unauthorized access to the service, or
- use the service for anything illegal.
We can suspend or terminate accounts that violate this.
Your customers’ data
Any data about your own customers that you enter into Followly remains yours. You’re responsible for having a lawful basis to collect and process it under applicable data protection law (GDPR, if you or your customers are in the EU); Followly processes it only as your processor, on your instructions, as described in our Privacy Policy.
Intellectual property
Followly owns the software, design, and branding. You own your data. Nothing in these terms transfers ownership of one to the other.
Disclaimers
Followly is provided “as is.” We work to keep it running and accurate, but we don’t guarantee it will be uninterrupted or error-free, and we’re not liable for decisions you make based on its output beyond what applicable law requires. To the extent permitted by Belgian law, our liability is limited to the amount you paid us in the 12 months before a claim.
Termination
You can close your account at any time. We can terminate or suspend your access for breach of these terms, non-payment, or if required by law, and will give notice where reasonably possible.
Changes
We may update these terms as the product changes. Material changes will be reflected here with an updated date; continued use after a change means you accept the update.
Governing law
These terms are governed by Belgian law, and disputes are subject to the exclusive jurisdiction of the Belgian courts.
